A new development procedure was approved, the adoption of the change and the exclusion of the EAEU TR

The procedure for the development, adoption, amendment and cancellation of the EAEU TR is adopted in a new edition.

On March 1, 2022, the Order of the Board of the Eurasian Economic Commission (EEC) No. 26 dated February 22, 2022 on amending the procedure for developing, adopting, amending and canceling the technical regulations of the Eurasian Economic Union (EAEU TR) was officially published and immediately came into force.

For final approval, the document will be submitted to the EEC Council for consideration.

Now the procedure will be carried out in 7 stages, instead of 5:

  1. Preparation and approval by the EEC of a plan for the development of technical regulations and amendments to them, amendments to the plan.
  2. Preparation of a draft EAEU TR/draft amendments to the EAEU TR.
  3. Conducting a public discussion of the project.
  4. Refinement of the project based on the results of public discussion. (previously not included in a separate paragraph).
  5. Carrying out intrastate coordination of the project.
  6. Conducting legal due diligence and legal editing of the project (previously not).
  7. Adoption of the EEC document.

It was decided to add a list of products to the set of documents to the Technical Regulations, the application of a mandatory assessment of compliance with the requirements of the EAEU TR.

In practice, such a list is formed as necessary for each regulation, but it is only now being included in the procedure for developing regulations.

Also, some clarifications were made on the timing of the procedures. For example, it is specified that the finalization of the project should take no more than 25 working days.

The clarifications also touched upon the rules for the adoption of the Technical Regulations. It has been established that the decision regarding the adopted EAEU TR on its entry into force and on transitional provisions is made by the EEC Board no later than 3 months before the date of entry into force.

Additionally, it is highlighted that the decision to adopt the EAEU TR must necessarily set the following deadlines:

  • validity of previously adopted documents on product conformity assessment with mandatory requirements, as well as the terms after which the issuance or acceptance of such documents is not allowed;
  • admission of production and release into circulation in the territories of the EAEU member states of products under the "old" permits or without them.
